Not always. But often, yes. As of April 1, 2025, California estates with qualifying assets over $208,850 (not counting the primary residence) generally go through probate. And if the primary residence is worth more than $750,000, that alone can trigger probate without a trust. A will says who gets what after you pass. But it usually still goes through probate. A living trust can pass your assets to your loved ones without probate, which often saves months (sometimes years) and real money. Most of our clients use both, working together.
